1. Acceptance of Terms

By booking a fishing charter or other service (“Services”) with Anglers Edge Fishing Guides (“we,” “us,” “our”), or by accessing and using our website https://anglersedgefl.com (the “Website”), you (“you,” “Client,” “Guest”) agree to these Terms & Conditions and any other rules, policies, and notices posted on the Website. If you do not agree to these Terms, you may not book or participate in our Services or use the Website.

2. Services / Booking / Payment

2.1 Booking – All Services must be booked via the Website, phone, or email, and confirmed by us. A deposit or full payment may be required to secure your reservation.
2.2 Payment – You agree to pay all fees posted for the charter or service you select. We accept Zelle, Venmo, cash or check as specified. Any travel, fuel surcharge, lodging or other ancillary cost is clearly stated at the time of booking (if applicable).
2.3 Cancellation & Rescheduling – Our cancellation/rescheduling policy (as described on the Website or at booking) applies. Unless otherwise stated:

  • If you cancel less than 24 hours before the trip, you may forfeit your deposit or be charged the full price.
  • We may reschedule due to safety, weather, mechanical failure or other conditions beyond our control.

2.4 No-Shows – If you fail to show up at the designated time and place without prior notice, you may be responsible for the full trip cost.

3. Assumption of Risk; Release; Safety

3.1 You acknowledge that fishing charters and related activities involve inherent risks, including but not limited to: slippery surfaces, changing weather and sea conditions, equipment failure, moving parts, marine life, boarding/deboarding, travel over water, etc.
3.2 You accept and assume all risks of bodily injury (including death) and property damage, whether caused by our negligence or otherwise, arising from or related to your participation.
3.3 Release – You hereby release, waive, discharge and covenant not to sue Anglers Edge Fishing Guides, its owners, captains, crew, agents, employees and affiliates (collectively, “Released Parties”) from any and all liability for injury, death or property damage arising from your participation, whether caused by the Released Parties’ negligence or otherwise.
3.4 Safety Instructions – You agree to follow all safety instructions given by the captain or crew. Failure to follow instructions may result in termination of your trip without refund.
3.5 Health & Fitness – You certify that you are physically fit and capable of participating in fishing charters. If you have medical, physical or other conditions that may impact your safety or enjoyment, you should consult your physician before booking and notify us in advance.

4. Weather, Water Conditions, Mechanical, Fish & Wildlife Laws

4.1 Weather/Water Conditions – We reserve the right to delay, shorten, reschedule or cancel a trip due to weather, water conditions, mechanical failure, fuel shortages, regulatory closures or other safety-related reasons. We aim to notify clients as soon as possible.
4.2 Fishing Success – We cannot guarantee you will catch any fish, a particular species or size. Success depends on variables out of our control.
4.3 Laws & Regulations – You agree to abide by all federal, state and local laws regarding fishing, fish size and bag limits, protected species and conservation. It is your responsibility to have valid fishing licenses/permits unless we have agreed to provide them. We will comply with all applicable regulations.

5. Limits of Liability

5.1 Notwithstanding anything else, in no event shall the Released Parties be liable for any indirect, incidental, special, exemplary or consequential damages, including loss of use, loss of opportunity, loss of enjoyment, delay, or economic loss, whether based in contract, tort (including negligence), strict liability or otherwise.
5.2 Our total aggregate liability to you for any claim arising under or related to these Terms or our Services shall not exceed the total fees paid by you for the affected trip or service.

6. Conduct & Crew Discretion

You agree to conduct yourself responsibly, behave safely and respectfully toward the captain, crew, vessel, equipment and other clients. We reserve the right to refuse service or remove any person whose behavior is unsafe, disruptive, intoxicated, or contrary to instructions. No refund will be issued in those circumstances.

7. Use of Images / Marketing

We (and/or our partners) may take photographs or video of the trip. By participating you grant us the right to use, publish or distribute photos/video of you for promotional or marketing purposes, unless you notify us in writing ahead of time. If you prefer otherwise, please advise us in advance.

8. Cancellation or Termination by Us

We may cancel or terminate a trip or service for any reason, including safety concerns, mechanical issues, weather, crew illness, or regulatory changes. When we cancel, we will offer a reschedule or refund of payments made for that trip. We will not be liable for additional costs (travel, lodging, meals, etc.) incurred by you.

9. Third-Party Links and Services

Our Website may contain links to third-party sites or services (e.g., fishing license agencies, lodging partners). We are not responsible for the content or operations of those sites, and your use of them is subject to their terms.

10. Intellectual Property

All content on the Website (text, graphics, logos, images, audio, video, software) is owned or licensed by Anglers Edge Fishing Guides and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, modify or distribute content without our prior written consent.

11. Privacy

Our Privacy Policy describes how we collect, use and protect your personal information. By using our Website or booking Services you agree to the terms of the Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. Any dispute arising under or relating to these Terms or your booking shall be resolved exclusively in the state or federal courts located in Broward County, Florida. You hereby submit to the personal jurisdiction of such courts.

13. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. The failure of us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14. Changes to Terms

We reserve the right to modify or update these Terms at any time. The revised Terms will be posted on the Website with an updated effective date. Your continued use of the Website or booking of Services after any such change constitutes your acceptance of the updated Terms.

15. Entire Agreement

These Terms, together with the Booking Confirmation, our Cancellation Policy and the Privacy Policy, constitute the entire agreement between you and Anglers Edge Fishing Guides regarding the Services and supersede any prior or contemporaneous agreements, understandings or communications.
